These Terms of Service govern your use of products and services provided by Precision Compounding, an FDA-registered 503B outsourcing facility. By opening an account or placing an order, you agree to these terms.
1. Eligibility and Account Requirements
Our products are available only to licensed healthcare professionals, clinics, and facilities authorized to prescribe, dispense, or administer pharmaceutical products. Account applicants must provide:
- Valid professional license (DEA, state pharmacy license, or medical license)
- Practice or facility information
- Proof of authorization to purchase pharmaceutical products
We reserve the right to verify credentials and deny account applications that do not meet our requirements.
2. Product Use and Restrictions
All products are compounded for professional use only and must be:
- Used only by or under the supervision of licensed healthcare professionals
- Administered in accordance with applicable laws and regulations
- Stored and handled according to product specifications
- Not resold to unauthorized parties
3. Ordering and Pricing
Pricing is subject to change without notice. Orders are subject to acceptance and product availability. We reserve the right to limit quantities or refuse orders. Payment terms are net 30 days for approved accounts, or prepayment may be required. Past due accounts may be subject to interest charges and suspension of ordering privileges.
4. Shipping and Delivery
Products are shipped via temperature-controlled logistics. Title and risk of loss pass to the customer upon delivery. Customers must inspect shipments immediately upon receipt and report any issues within 24 hours. We are not responsible for delays caused by carriers or circumstances beyond our control.
5. Returns and Refunds
Due to the nature of pharmaceutical products, returns are generally not accepted except for documented quality issues or shipping errors. Any return must be authorized in advance and products must be returned in original, unopened condition within specified timeframes. Refunds or credits will be issued at our discretion.
6. Product Quality and Warranties
We warrant that products will meet specifications stated in the Certificate of Analysis at the time of shipment. This warranty is limited to replacement or refund and excludes all other warranties, express or implied. We are not liable for consequential, incidental, or indirect damages.
7. Adverse Event Reporting
Customers must report any suspected adverse events, product quality issues, or complaints immediately to our quality assurance department. We maintain an adverse event reporting system in compliance with FDA requirements.
8. Confidentiality
Both parties agree to maintain confidentiality of proprietary information, including but not limited to pricing, formulations, and business practices. This obligation survives termination of the business relationship.
9. Limitation of Liability
Our total liability for any claim shall not exceed the purchase price of the product at issue. We are not liable for indirect, consequential, incidental, or punitive damages. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
10. Compliance with Laws
Customers are responsible for compliance with all applicable federal, state, and local laws regarding the purchase, storage, handling, and administration of pharmaceutical products. This includes but is not limited to DEA regulations, state pharmacy laws, and medical practice acts.
11. Modifications to Terms
We reserve the right to modify these terms at any time. Continued use of our products or services after changes constitutes acceptance of modified terms. Material changes will be communicated to account holders.
